1. The service
BrickTrace provides software that connects your point-of-sale (POS) system to advertising and marketing platforms, matches in-store transactions to conversions, sends those conversions to the platforms you enable, and provides related analytics.
2. Accounts
You must provide accurate account information and keep it up to date. You are responsible for safeguarding your login credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use.
3. Your data and your responsibilities
You retain ownership of the transaction and customer data you bring into BrickTrace. You grant us a limited license to process that data solely to provide the service to you.
You represent and warrant that you have the necessary rights and, where required, consent to:
- collect the customer data captured by your POS;
- upload it to BrickTrace; and
- share it with the advertising platforms you connect for conversion measurement.
You are responsible for complying with all applicable laws (including privacy and consumer-protection laws) and with the terms and policies of each platform you connect, including Meta, TikTok, and Klaviyo.
4. Connected platforms
When you connect a platform, you authorize BrickTrace to access that account and to send conversion data on your behalf using the access you grant. Your use of each platform remains subject to that platform's own terms. Platforms may change, limit, or discontinue their APIs, which can affect the service; we are not responsible for changes made by third-party platforms.
5. Acceptable use
- Do not use the service for unlawful purposes or to process data you have no right to use.
- Do not attempt to breach security, access other tenants' data, or disrupt the service.
- Do not misrepresent conversions or use the service to violate any platform's policies.
6. Fees and billing
Some plans are paid. Where fees apply, they are described at sign-up or in your order, and billing is handled through our payment processor. Unless stated otherwise, fees are non-refundable except as required by law. We may change pricing on a prospective basis with notice.
7. Intellectual property
BrickTrace and its software, design, and content are owned by us and protected by law. These terms do not grant you any right in our intellectual property other than the limited right to use the service.
8. Privacy
Our handling of personal data is described in our Privacy Policy, which forms part of these terms. Where BrickTrace processes personal data on your behalf, that processing is subject to a data processing agreement available on request.
9. Disclaimers
The service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the service will be uninterrupted or error-free, or that any particular advertising outcome, attribution accuracy, or return on ad spend will be achieved.
10. Limitation of liability
To the maximum extent permitted by law, BrickTrace will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability arising out of or relating to the service will not exceed the amounts you paid to us for the service in the twelve months before the event giving rise to the claim.
11. Indemnification
You agree to indemnify and hold BrickTrace harmless from claims arising out of your data, your use of the service, or your violation of these terms, applicable law, or any platform's policies.
12. Termination
You may stop using the service and close your account at any time. We may suspend or terminate access if you breach these terms or use the service in a way that risks harm to others or to the platforms we integrate with. On termination, your right to use the service ends; you may request deletion of your data as described in the Privacy Policy.
13. Changes to these terms
We may update these terms from time to time. We will revise the "Last updated" date above and, for material changes, take reasonable steps to notify you. Continued use after changes take effect constitutes acceptance.
14. Governing law
These terms are governed by the laws applicable at BrickTrace's principal place of business, without regard to conflict-of-laws rules. Any disputes will be resolved in the competent courts of that jurisdiction.
